License Agreements and Policies for Stock Video Footage Sales

All purchases are subject to the applicable license or policy listed below. Each clip has a specific license type listed in the License Terms section of its preview page. It is your sole responsibility to review the license terms of each video clip before making a purchase. Here are the three licenses/policies:

License In Effect & Termination Of License

Green Stock Media royalty free video clips can be used for all allowed uses as often as you wish at no additional cost. You are granted a non-exclusive, non-transferable license to use and modify the Green Stock Media stock video clips and/or collections of clips you have purchased subject to the conditions in this license. By purchasing Green Stock Media video clips you agree to be bound by the terms of this agreement. Clips made available for preview purposes, whether on physical media or online, are not licensed for any use, but they may be incorporated as placeholders in rough cuts. All rights granted you under this license shall automatically terminate upon your breach of any provision of this license.

Allowed Uses

Except as limited by the restrictions and other terms outlined in this license, the Green Stock Media clips covered by this agreement may be used by a single user and incorporated into such derivative work as feature films, television programs, documentaries, training programs, educational programs, public information materials, display videos, web site videos, multi-media products, advertisements, live performances or presentations, and related educational and commercial video productions. They may be used as many times as you wish and in as many products as you wish, worldwide and in perpetuity.

Usage Restrictions

You may not rent, lend, sell, re-sell, lease, sub-lease, license, sub-license, or in any fashion transfer Green Stock Media clips and/or collections to any other individual or entity for use or sale as stock footage. Green Stock Media clips may not be used, reproduced, copied, shared, or distributed as stand-alone video clips, they may not constitute more than 25 percent of your finished product, your product may not be made available as full-resolution files unprotected and downloadable without charge, and no part of any Green Stock Media clips may be included in other collections of stock footage for distribution or sale. In addition, you agree not to give permission to anyone, including your clients or customers, to duplicate, use, or distribute any of the Green Stock Media clips included in your product except as an integral part of your whole finished product or in conjunction with and limited to advertising or promoting that product. You may not use a Green Stock Media clip or clips (or any part thereof) as or in trademarks or service marks, nor may you claim any proprietary right to any (or any part of) a Green Stock Media clip.

No Improper, Illegal, Or Legally Questionable Uses

Green Stock Media lists whether or not Model and/or Property Releases are available for each clip. It is your sole responsibility to determine whether or not Model and/or Property Releases are required for your particular project regardless of which License is associated with a clip. Clips provided by Green Stock Media may not be used in any product any part of which is defamatory, libelous, obscene, pornographic, fraudulent, or in any manner illegal or of questionable legality.

Indemnity

You agree to indemnify and hold Green Stock Media harmless from and against all claims, losses, damages or liabilities arising from your use of Green Stock Media clips in the event of any negligent or willful act or omission on your part resulting in a breach of any of the terms and conditions of this agreement.

Green Stock Media Liability

Green Stock Media and its affiliated videographers will not be liable for any damages for financial losses of any kind arising out of the use of or the inability to use any Green Stock Media clips. Licenser's entire liability and your exclusive remedy will be the amount paid for the clips and no more.

Copyright

Either Green Stock Media or its affiliated videographers holds the copyright on clips. They are protected by United States Copyright laws and international treaty agreements. All rights are reserved by Green Stock Media and/or its affiliated videographers. No intellectual property rights are transferred to you, and Green Stock Media and its affiliated videographers retain all rights not expressly granted by this license.

Limited Warranty

Green Stock Media warrants any physical media (CD, DVD, MiniDV, etc.) used to convey the original video clips accurately and in full for 30 days from delivery. Green Stock Media makes no other warranties about the stock footage clips conveyed on physical media or delivered electronically, and any implied warranties of merchantability, fitness for a particular purpose, title or noninfringement are hereby disclaimed. Some clips may contain slight flaws, including but not limited to minor focus or exposure variations, minor scratches, or lens obstructions. Video clips are sold AS IS. Purchasers are encouraged to preview footage when their production schedule permits. Purchaser's sole and exclusive remedy under this limited warrantee is the replacement of damaged or defective physical media or, at the sole discretion of Green Stock Media, a refund of the purchase price (in the event of damaged or defective delivery media ONLY).

Return Policy

Green Stock Media stock footage products are nonrefundable (unless the physical media itself is delivered damaged - see Limited Warranty above). Please review preview clips thoroughly before purchasing and contact us with any questions.

Severability

If any provision of this license is to any extent found invalid or unenforceable, the remainder of this license shall not be affected. Each provision shall be valid and enforced fully.

Jurisdiction

Green Stock Media is a California business and the parties agree that any disputes will be adjudicated under the laws of California and in California courts and/or arbitration services.

Entire Agreement

This is the entire agreement between Green Stock Media and stock purchaser. It may not be modified or amended by either party without written agreement by both.

Credit Line Appreciated

Green Stock Media would appreciate a credit line on finished products whenever applicable. Credit to the Source or Videographer is also appreciated. An example would be: Videographer/Green Stock Media

License & Policy Distinctions

The General Use License Agreement covers our clips that are licensed for all general uses. Some of our clips are licensed for and identified as "Editorial Use Only." These clips are are covered by our Editorial Use Only License Agreement. Green Stock Media also offers some clips that we believe are in the public domain. Our fee for these groups is based on recovering our costs to find, assemble, reproduce and deliver these clips and not on any charge for the clips themselves. More information is available in our Public Domain Footage Policy.

This may include such products as television programs, documentaries, training programs, educational programs, public information materials, public information display videos, web site public information videos, multi-media educational products, live presentations, and related informational and educational video productions. Use in advertising and related forms of commercial speech is not allowed. Clips may be used as many times as you wish and in as many products as you wish, worldwide and in perpetuity.

Public Domain Footage Policy

Green Stock Media offers some clips that we believe are in the public domain. Public domain is a term that refers to works that are no longer protected by copyright. Our charge for these groups is based on recovering our costs to find, assemble, reproduce and deliver these clips and not on any charge for the clips themselves.

Because we have no rights ownership, this is not a license. Your use of the clips in public domain groups is not restricted by Green Stock Media.

While we believe the clips in these groups are in the public domain, we do not warrant that to be the case. Your use of these clips is entirely at your own risk.

While we have no copyright claim to these clips, that does not mean that the persons or places shown have no right of privacy, right of publicity, or trademark rights and may require Model and/or Property Releases. Therefore if a recognizable person, brand name, or logo appears in a clip, the right to use that clip may be limited. For these reasons, users may be well advised to restrict use of public domain footage containing a recognizable person, brand name, or logo to noncommercial applications, or "editorial only."
